Applicability of EPCRA Tier II
The Emergency Planning and Community Right-to-Know Act (EPCRA) Tier II reporting requirement applies to facilities that store hazardous chemicals above specific threshold quantities. Facilities with 10,000 pounds or more of a hazardous chemical requiring a Safety Data Sheet (SDS) under OSHA’s Hazard Communication Standard must submit an annual Tier II report. Lower thresholds apply to extremely hazardous substances (EHS) listed under EPCRA’s Section 302.
